Procedure

  1. Lay of Information - review of all factual detail
  2. Arraignment - Accused enters plea (bargain, guilty, or not guilty)
  3. Trial - Judge and/or jury
  4. Sentencing (if required)

Burden of Proof

  • Rests with the Crown (prosecution, state lawyer)
  • State must prove accused guilty
  • Presumption of innocence guaranteed to accused (CCRF 11d)

Proof Required

  • Must prove guilt beyond a reasonable doubt (no doubt in jury mind) that the person had mens rea and actus reus.

Finding (result)

Guilty (conviction) or Not Guilty (acquittal)
